RERA vs Home Buyers: Haryana RERA has said in an order that until the 7 towers of Gurugram’s Green View Society are demolished and rebuilt, NBCC company will have to pay Rs 30,000 per month to every home buyer. You can guess how important the Real Estate Regulatory Authority (RERA) is from the arbitrariness happening in a society in Gurugram. If this law had not come, the builders and companies would have taken the money of the common man and the house would not have been available.
To protect the interests of the customers, in one such case, the RERA of Haryana has ordered the National Building Construction Company (NBCC) that until the house buyers get their house, they will have to pay 30 thousand rupees every month as rent. If the company does not pay the money, then it will also have to pay interest at the rate of 10.50 percent per annum.
This is the case of Green View Society built in Sector 37D of Gurugram. Hundreds of people bought flats in this society and after some time cracks started appearing in it. On this, the engineers of IIT Roorkee inspected the flat and declared it unfit for living, calling it dangerous. After this, in March 2022 itself, people vacated this flat and started living on rent at another place. Saurabh Mehta and Jai Prakash Mehta, among the home buyers, filed a case in the RERA court, on which this order has come.
By when will the money have to be paid
The RERA court has said in its order that the house buyers should pay this amount within a month. If the money is not paid, then 10.50 percent interest will also have to be paid annually. NBCC had issued a plan to demolish these flats and rebuild them, which was stopped by the district administration.
The district administration says that many legal cases are going on regarding the society and compensation has also not been given yet. Therefore, there will be a ban on demolishing the building until these cases are settled.
Waiting for the order of Delhi High Court
The district administration says that the economically weaker section people who bought houses in this building have claimed compensation in the Delhi High Court. The building cannot be demolished until the order comes from the court. The administration has also appealed to the commissioner to get the registration of the house buyers done soon, so that they can get compensation from NBCC.
7 towers will be demolished
NBCC had said that the 7 towers built in this society are completely in the danger zone and there is a danger to the people living in them. Therefore, these towers should be demolished as soon as possible.
In this regard, the District Magistrate had also issued his order that the towers should be demolished and rebuilt soon, so that the interests of the house buyers can be protected. Now until the tower does not fall, NBCC will have to pay 30 thousand rupees per month to every house buyer.
