Know what the law says?

According to the Hindu succession law in the Constitution of India, a daughter has the same right to her father’s property as a son. Let us tell you that this law was made in the year 1956. But in the year 2005, some changes were made in this law.

In this change it was said that if a father has his own property then his son and daughter will have equal share in his property. Let me tell you that even if the daughter is married, it will not make any difference. Apart from this, if the father dies suddenly and there is no will in anyone’s name, then the son and daughter will get equal share.

Let us tell you that in the year 2020, the Supreme Court had given a decision in which it was said that even if someone’s ancestral property is divided, the daughter has the right over it.

When do daughters not inherit property?

Let us tell you that when a daughter gives up her rights, she does not get the right in her father’s property. It also does not matter whether his father acquired the property himself or inherited it.

If a daughter voluntarily gives up her father’s property, then if a release deed is written and that release deed is registered, then the daughter will have no rights of any kind in her father’s property. But it doesn’t last. After this the daughter cannot ask for any kind of share.

What to do if property is not found?

Let us tell you that if the daughter does not get the father’s property, then she can file a case against it in the court. After this, when the case is heard, if the claim is found to be true then the daughter can get a share in her father’s property.
