In this article we will tell you that if the seller of the property is reluctant to register it even after the completion of the deal, then what are the legal provisions to deal with this problem-

There is provision for civil and criminal cases-

It is the responsibility of the person selling the property to give written ownership rights over the property to the buyer after taking the full amount from the buyer i.e. to get the property registered. But if the seller of the property is reluctant to register the property even after taking money or is postponing it by making false promises, then it falls under the category of legal crime. Such cases are settled through both civil and criminal trials. To deal with such cases, proper provision has been made in the Indian Penal Code 1860. For this, punishment can be given through sections 406 and 420 of IPC.

Section 406 of IPC-

Under this section, if someone’s money or property has been appropriated or embezzled by wrongful means or by fraud (which is also called fraud), then it is a crime. Under this, the guilty person can get a punishment of 3 years.

Section 420 of IPC-

Often, when someone’s property or money is appropriated through lies, fraud, deceit or other such means, punishment is given under this section. If the property owner does not take the money and register, the victim can file a case under this section. Even after a case registered under this section, there is a provision for strict punishment for the person.
