Good news for pensioners! Supreme Court rejects special petition on Commutation Recovery for 15 years

The Supreme Court has rejected a Special Leave Petition filed by Punjab National Bank (PNB) on 9 August 2024 regarding Commutation Recovery for 15 years. The Supreme Court has issued an important order on this. This petition was filed by Punjab National Bank against an order given by the Punjab and Haryana High Court on July 18, 2024.

What was the whole matter
For your information, let me tell you that on July 18, 2024, the Punjab and Haryana High Court had given a very big decision regarding commutation recovery, in which the court said that the actual recovery of commutation is completed in 11 years and 6 months, in such a situation the government has no right to continue making further recovery. The court directed the government to stop the recovery of the petitioners with immediate effect. After the stay by the High Court, Punjab National Bank filed a Special Leave Petition in the Supreme Court against this decision. On which the decision has come.

Petition dismissed in Supreme Court
The matter was heard on August 9, 2024 before a bench of Supreme Court Justices B.R. Gavai and K.V. Vishwanathan. Before the hearing of the case, the lawyers of PNB requested the Supreme Court that they want to withdraw this petition and they should be allowed to take other remedies available under the law. The Supreme Court accepted this request, allowed the petition to be withdrawn and dismissed the petition.

The Supreme Court clarified in its order:

1. The counsel for the petitioner sought permission to withdraw the petition.

2. The Court granted this permission.

3. The special leave petition was dismissed on the ground that it was being withdrawn and the petitioner was given the liberty to pursue other remedies under the law.

With this order, the Court ended the matter.

Recovery of all will be stopped
Withdrawal of the petition by Punjab National Bank (PNB) in the court makes it clear that pensioners have the upper hand. However, no common circular has been issued by the government on this, so if pensioners approach the court, only then will they get the benefit. Therefore, all the pensioners whose recovery has completed 11 years and 6 months, their further recovery will be stopped. For this, pensioner organizations will have to come together and file a PIL i.e. Public Interest Litigation in the Supreme Court to get all the pensioners their rights.

Why is PIL necessary
If pensioners file petitions one by one, then they will get benefits but they will also have to spend money, so all pensioners should unite and file a PIL together so that pensioners do not suffer financial loss and their work is also done and other pensioners also get the benefit.
